These General Contest Rules are applicable to all contests and promotions conducted by Jonard Tools and should be read in conjunction with any promotion-specific rules published by Jonard Tools for a particular promotion. Participation in any of these promotions constitutes the Participant’s agreement and acceptance of these Rules. All federal, state, local, municipal laws and regulations apply.

Eligibility:
Contests are open to legal residents of the fifty (50) United States, who are eighteen (18) years of age or older at the time of entry and have Internet access with a valid e-mail account prior to the beginning of the Contest Period. Jonard Tools has the right to verify the eligibility of each entrant. Employees of Jonard Tools, Jonard Tools Partners and their respective parents, subsidiaries, affiliates, contests, and advertising agencies and members of their immediate family (spouse, parent, sibling or child and their respective spouses, regardless of where they reside) and persons living in the same household of such employees, whether or not related, are not eligible to enter or win. Void where prohibited by law. Contests are subject to all applicable federal, state, and local laws. Disqualification may include the use of inappropriate language or visuals on the winners' social media account. We have the right to investigate possible cheating or tampering before we determine a winner.
Submission of photo, text or other content for contests:
Entries selected for display and to win "best of" contests and any other contests requiring photo, text or other content from the entrants will be judged entirely at the discretion of Jonard Tools.
By submitting any photo or information to Jonard Tools, you hereby grant to Jonard Tools and its affiliates, subsidiaries, licensees and assigns, an irrevocable, perpetual and royalty-free right to use, reproduce, edit, display, transmit, prepare derivative works of, modify, publish and otherwise make use of the submitted photo or other information in any and all media, whether now known or hereinafter created, throughout the world and for any purpose. In addition to other things, the rights granted to Jonard Tools include but are not limited to the right to resize, crop, censor, compress, edit, feature, caption, affix logos to, and to otherwise alter or make use of the submitted photo. By submitting any photo or information to Jonard Tools, you hereby represent and warrant that the submitted photo or information does not and shall not infringe on any copyright, any rights of privacy or publicity of any person, or any other right of any third party, and you have the right to grant any and all rights and licenses granted to Jonard Tools herein, including but not limited to all necessary rights under copyright, free and clear of any claims or encumbrances.
You acknowledge and agree that Jonard Tools shall have no obligation to post, display or otherwise make publicly available any photo or information submitted by you, and may, in its sole and unfettered discretion, remove, edit, modify or delete any photo or information that you submit to Jonard Tools.
You understand and intend that any photo or information submitted by you to Jonard Tools may be available for viewing, rating, review, and comment on by the public, and understand that comments or ratings with which you disagree or are unhappy about may be published or otherwise become associated with any photo or information you submit to Jonard Tools. By submitting any photo or information to Jonard Tools, you hereby waive any privacy expectations that you may have with respect to any such photo or information submitted by you to Jonard Tools.
You hereby agree to hold Jonard Tools and its affiliates, subsidiaries, licensees sponsors and assigns harmless from and against, and hereby waive any right to pursue, any claims of any nature arising in connection with the inclusion in, publication via or display on any Jonard Tools site, or any other use authorized under these Terms, of any photo or information submitted to Jonard Tools by you.
Photos or information submitted by you to the Site or social media shall be the property of Jonard Tools, and Jonard Tools shall have no obligation to preserve, return or otherwise make available to you or others any photos or information so submitted.
Limitations on Liability:
The prize is non-transferable. No substitution or cash equivalent of prizes is permitted. By entering the promotion, You agree to release and hold harmless Jonard Tools and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from:
[1] Such entrant’s participation in the promotion and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof;
[2] Technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, software, or other mechanical equipment;
[3] The unavailability or inaccessibility of any transmissions, telephone, or Internet service;
[4] Unauthorized human intervention in any part of the entry process or the promotion;
[5] Electronic or human error in the administration of the promotion or the processing of entries.
Sponsor will not be liable to Winner or any other person for failure to supply any prize or any part thereof, by reason of any action(s), regulation(s), order(s), or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulation(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, earthquake, war, fire, flood, explosion, unusually severe weather, hurricane, pandemic, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other cause beyond Sponsor’ control. Any typographical or other errors in the offer or administration of the contest, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize.
Disputes and Arbitration:
This promotion is governed by the laws of the United States of America and New York, without respect to conflict of Law Doctrines. As a condition of participating in this promotion, the participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Promotion, shall be resolved individually, without resort to any form of class action, exclusively before a court located in New York having jurisdiction.
Terms & Conditions:
By entering this Contest, participants agree that neither Jonard Tools, Twitter, Facebook nor Instagram shall be liable for personal injuries, death, damages, expenses or costs or losses of any kind resulting from participation or inability to participate in this Contest or acceptance of or use of or inability to use the prize or parts thereof, including, without limitation, claims, suits, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light (whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory. Winner acknowledges that Jonard Tools has neither made nor is in any manner responsible for any warranty, representation, or guarantee, expressed or implied, in fact, or in law, related to the prize. Jonard Tools reserves the right to cancel, terminate, modify or suspend the promotion should virus, bug, non-authorized human intervention, fraud, or any other cause affect the administration, security, fairness, or proper conduct of the promotion. If such a case occurs, Jonard Tools may select the Winner from all eligible entries. If cancellation, termination, modification or suspension occurs, a notification will be posted on www.jonard.com
Caution: Any attempt by a participant to deliberately undermine the legitimate operation of the contest is a violation of criminal and/or civil laws and should such an attempt be made, Jonard Tools reserves the right to seek damages and other remedies from any such person to the fullest extent permitted by law.
Winner Notification:
Winners of all contests will be contacted at the "entry" email address or username used to enter the contest, and the person receiving and replying to the winner announcement email will be considered the winner unless they specify another person within the reply email as the winner. Jonard Tools will mail the contest prize to the address supplied by the recipient of the winner announcement email or Instagram account. Any prize not claimed within 14 days will be forfeited by the winner and remain the property of Jonard Tools. Jonard Tools is not required to award elsewhere any prizes forfeited by the chosen winner(s). Acceptance of the prize gives Jonard Tools permission to use the Winner’s [personal details and comment, photo, an audio file, video, text, etc.] for advertising purposes without further compensation unless it is prohibited by law. We will not disclose the winner's address or phone number to the public.
Jonard Tools asks if the winner is willing to take a photo of yourself holding your prize and tag us in a post or send a photo or video for future posts of the contest winners. (Not required but encouraged.)

By participating, each participant is granting Jonard Tools permission to use his/her/business name, contest entry, likeness or comments for publicity (or future marketing purposes).

Jonard Tools is not responsible for and will not consider incomplete or incorrect entries. Entries generated by script, macro, mechanical or other automated means and entries by any means which subvert the entry process are void. All entries become the sole property of Jonard Tools and will not be returned.

Random Drawing:

We select One (1) potential Grand Prize winner at random from among all eligible entries received and combined throughout the Contest Period, whether you followed all three steps above and depending how many people you tag in the Instagram comments.
